Service Hopper Lite Terms of Service

These Terms of Service ("Terms") govern your access to and use of Service Hopper Lite (the "App"), a routing-focused mobile application owned and operated by Optimal Pools, LLC ("Optimal Pools, LLC" "we," "us," or "our"). Service Hopper Lite is a lighter version of the Service Hopper platform and is intended to help users manage local route planning, recurring stops, proof photos, and customer communication through Apple-provided tools.

By downloading, accessing, or using Service Hopper Lite, you agree to these Terms. If you do not agree, do not use the App.

1. Eligibility and Account Model

Service Hopper Lite is designed for individual operators and small businesses. The App does not require a separate Service Hopper Lite username or password. Access to paid features is controlled through your Apple App Store account and, where available, device-level iCloud services.

You are responsible for:

- maintaining access to your Apple ID and Apple services;

- ensuring your device is compatible and properly configured;

- complying with all laws and regulations that apply to your business and communications.

2. License

Subject to these Terms and any applicable App Store rules, Optimal Pools, LLC grants you a limited, non-exclusive, non-transferable, revocable license to use Service Hopper Lite for your internal business or personal route management purposes.

You may not:

- copy, modify, distribute, sell, lease, sublicense, or reverse engineer the App except as allowed by applicable law;

- use the App in a way that violates any law, regulation, or third-party right;

- use the App to send unlawful, deceptive, harassing, or unwanted messages;

- interfere with or disrupt the App, Apple services, or other users' use of Apple services.

3. Subscription Billing and App Store Terms

Service Hopper Lite is offered as an auto-renewable monthly subscription through Apple In-App Purchase.

By purchasing a subscription, you acknowledge and agree that:

- payment is processed by Apple, not directly by Optimal Pools, LLC

- your subscription automatically renews unless you cancel at least 24 hours before the end of the current billing period;

- your Apple account may be charged for renewal within 24 hours before the end of the current billing period;

- you can manage or cancel your subscription through your Apple account settings;

- pricing may vary by region, taxes, currency, and App Store storefront.

If Apple offers a promotional period, introductory offer, or free trial for Service Hopper Lite, any unused portion may be forfeited when you purchase a subscription, where permitted by law and Apple policy.

Your use of Apple billing services is also subject to Apple's terms, policies, and App Store rules.

4. App Features and Intended Use

Service Hopper Lite is a local-first routing app. Depending on your device setup and permissions, the App may allow you to:

- create and manage local client records;

- assign recurring route visits and stop order;

- track route progress and stop completion;

- capture or choose proof photos for a stop;

- open Apple's Messages composer with a prefilled proof text and optional photo attachment;

- import selected contacts from your device's Contacts app;

- sync supported app data across your own devices using the same Apple ID when iCloud is available.

Service Hopper Lite is not a dispatch center, emergency tool, legal compliance system, or guarantee of service completion. You are solely responsible for your actual field operations, business decisions, record-keeping obligations, and communications.

5. Contacts, Photos, Messages, and Permissions

Certain App features require permissions you control at the device level.

- Contacts

If you choose to import contacts, the App uses Apple's contact picker and imports only the contacts you select. You are responsible for ensuring you have the right to use any contact information you import.

- Camera and Photo Library

If you choose to take or select a proof photo, the App will request access to your camera or photo library as needed. You control whether to grant that access.

- Messages

If you choose to send a proof text, the App opens Apple's native Messages composer. You must manually review and send the message yourself. Service Hopper Lite does not auto-send text messages, does not send background messages, and does not operate as a mass messaging platform.

You are solely responsible for:

- the content of your messages;

- the recipients you choose;

- obtaining any required customer consent;

- complying with telecom, privacy, and marketing laws;

- any carrier, messaging, or data charges.

6. Local Storage and Optional iCloud Sync

Service Hopper Lite is designed to work locally on your device. If iCloud is available and enabled on your device, certain app data may also sync through Apple's iCloud / CloudKit services to your other devices using the same Apple ID.

We do not provide a separate custom cloud account system for Service Hopper Lite. Sync availability depends on Apple services, your device configuration, and your Apple account status.

We do not guarantee that:

- iCloud sync will always be available;

- sync will be immediate, uninterrupted, or error-free;

- synced data will appear on every device at the same time.

You remain responsible for reviewing your route data and maintaining any business records you need.

7. Your Data and Responsibilities

You are responsible for all information you enter into the App, including client names, phone numbers, addresses, notes, route assignments, proof photos, and messages.

You represent and warrant that:

- you have the right to input and use that information;

- your use of the App does not violate any agreement, law, regulation, or privacy right;

- you will not use the App for spam, harassment, deception, or unlawful activity.

8. Service Changes and Availability

We may update, improve, modify, suspend, or discontinue any part of Service Hopper Lite at any time, including features, design, eligibility rules, or subscription offerings. We may also release bug fixes, security updates, or compatibility changes.

We are not liable for issues caused by:

- Apple platform changes;

- App Store or iCloud outages;

- carrier or device limitations;

- third-party operating system behavior;

- unsupported devices or outdated software.

9. Intellectual Property

Service Hopper Lite, the Service Hopper Lite name, related branding, design, software, content, and associated materials are owned by Optimal Pools, LLC or its licensors and are protected by applicable intellectual property laws.

These Terms do not transfer ownership of any intellectual property rights to you.

10. Termination

These Terms remain in effect until terminated.

You may stop using the App at any time by removing it from your device and canceling your subscription through Apple if applicable.

We may suspend or terminate your access to the App, to the extent permitted by law, if we believe you have violated these Terms, abused the service, or created legal or operational risk.

Sections that by their nature should survive termination will survive, including sections relating to billing obligations, intellectual property, disclaimers, limitations of liability, indemnity, and disputes.

11. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SERVICE HOPPER LITE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY.

WITHOUT LIMITING THE FOREGOING, WE DISCLAIM ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, AND WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR SUITABLE FOR YOUR PARTICULAR BUSINESS NEEDS.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OPTIMAL POOLS, LLC AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, BUSINESS OPPORTUNITY, OR CUSTOMER RELATIONSHIPS, ARISING OUT OF OR RELATED TO THE APP OR THESE TERMS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO SERVICE HOPPER LITE WILL NOT EXCEED THE GREATER OF:

- THE AMOUNT YOU PAID FOR THE APP IN THE 12 MONTHS BEFORE THE CLAIM; OR

- USD $100.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

13. Indemnification

You agree to defend, indemnify, and hold harmless Optimal Pools, LLC and its affiliates, owners, officers, employees, and contractors from and against any claims, damages, liabilities, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

- your use or misuse of the App;

- your data, messages, or content;

- your violation of these Terms;

- your violation of any law or third-party right.

14. Governing Law

To the fullest extent permitted by law, these Terms are governed by the laws applicable to Optimal Pools, LLC's principal place of business, without regard to conflict of law principles.

15. Changes to These Terms

We may update these Terms from time to time. When we do, we will post the updated version with a new effective date. Your continued use of Service Hopper Lite after updated Terms become effective means you accept the revised Terms.
